What is a fair settlement for injuries sustained in an auto accident in which the other driver was at fault?

I was involved in a accident in which I was hit in the front & driver side I was driving an older blazer so It didn’t sustain much damage ($2500) However the at fault driver was in a much smaller auto that was totaled.My Knee had ruptured blood vessels, Meniscus tears, swelling,Bruising & severe pain, it Buckles & in 1 incident It caused me to fall injuring my knee even much more, I also had mild cervical strain,Right ankle sprain & upper & lower back pain. My PCP referred my to an orthopedic specialist, physical therapy & chiropractor. I have been in treatment for 22 weeks and have been released by PT & Chiropractor, to go back as needed.released by Ortho specialist to return for injections to knee as needed or other possible treatment. I continue to have pain & can’t sleep on right side but am considered as good as i will be. Also in the accident I had my 13 year old son with me who was thankfully not injured, but I drive him to & from school every day, during the 1st few weeks I could not drive and had very limited mobility. What would be a good settlement for these injuries?
The insurance company has paid to have my vehicle repaired. My Health insurance is paying for my medical bills but its my understanding that I will have to pay them back after the settlement.
What kind of injuries would these be considered? (Soft Tissue)?

What is the average settlement for an auto accident?

I was in an auto accident that ended up being a 6 car pile up. All the fault of the driver behind me. I was taken to the hospital for neck and head injuries. My car was totalled with over 9000.00 worth of damage. I went to physical therapy for 4 weeks along with going to a chiropractor. I ended up losing my job due to the time off needed to go to therapy so i wasnt able to finish my treatment. I lost over 1500.00 in wages and ultimately my job. I had over 7000.00 in medical bills too. I was just curious at to how much they pay out for pain and suffering. I know it was more of an inconvience more than anything but for 2 months I was going to at least 3 medical appointments a week. I’ve never been involved in an accident like this with injuries so I was just curious to if anyone had an experience like this and what the out come was.
Also after my car was totalled I’m still left owing 4500.00 for a car I no longer have. I don’t know if that makes a difference or not just thought to add that.

I hadn’t settled on the medical and lost wages. They had just taken care of the vehicle situation so far. I was the only one that had major damage to my vehicle and continued medical treatment. So my case is probably the last in line to be settled. I am not able to complete treatment because I’m out of work and don’t have the funds to pay out of pocket to get reimbursed later.

How do I figure out my personal injury settlement from an auto accident? (plus review part of demand letter)?

I’m currently writing a demand letter and need to know how much to ask for other than the medical bills that I have receipts for. I came across this calculator, but still am unsure on some things: http://www.after-car-accidents.com/personal-injury-calculator.html

For example, what would I put for lost income if I’m unemployed and have stayed unemployed due to prolonged issues with the car / auto shop as well as physical pain and stress? Would it count if I mentioned the inability to secure a job due to these things resulting from the accident?

Also, the car repair costs have already been paid off. It’s just the medical bills and others that I need to figure out. I’ve included a bit of what I’d like to say, but am unsure if this is too much or if it’s ridiculous to even mention. I’ve never written a demand letter before, so don’t know how it’s supposed to be done.

Here’s pieces of what I have so far:
“It has taken me a while to submit this demand letter since I have not been in the right mind state for some months. I suffer from depression and was previously taking medication however, shortly after the accident I stopped going back for refills so that I could use my money instead to correct the back, shoulder and neck pain resulting from the accident. Being unemployed, I had to decide what needed to be taken care of most and felt the physical pain to be much more debilitating. It’s been a very stressful past several months and I’ve been unable to secure a job since issues with my car and the auto shop as well as dealing with the physical pain and recurring depression, which has additionally made it very difficult to focus, has been taking up a lot of my time.

I am still suffering from back and shoulder pains, resulting in loss of sleep and fatigue due to the inability to sleep. Despite the pain and need for more treatment, I have had to stop chiropractic visits due to the lack of funds– funds which I was initially withdrawing from my emergency savings.”

Obviously I have a lot more to write out along with the necessary details of the accident + bills. BUT how is it so far? It feels weird to complain but I do want to be compensated for all the trouble because the accident was not my fault at all.

Any help would be really appreciated.
I’m writing this demand letter to the insurance adjusters– they are the ones who told me to do so, instructing me to mark down expenses as well as pain and suffering. I’ve already received a check to pay off the repairs to the car. They are just waiting for my letter and receipts. The thing I’m having trouble with is how much to ask for pain and suffering as well as what was mentioned above.

I was in an Auto Accident, dealing with doctors and hired a lawyer, How much of a settlement can I expect?

I was in a auto accident right after Christmas of 08. Since then I have been goign to Physical Therapy and a chiropractor 3 times a week since the beginning of January. I was having neck pain and low back pain as well as my left leg going numb and tingling and radiating pain down the leg to above the knee cap. The neck pain and back pain have gotten better however there main focuse right now is on the leg and to find out what is causing the numbness and tingling and shooting pain down. The Physical Therapist has mentioned that she believes there is some nerve damage and they want to schedule a MRI. They have cut my appointments down to two times a week starting Monday. I do have a lawyer and medical bills are somewhere around $5000.00 already. Does anyone know how long that this will require treatment and what the settlement offer should be?? Any help and advice would be appreciated. Thanks
I was at no fault. I was rearended and pushed forward into someone else. I was the only one that sustained injuries or had complaints at the time if the accident.

injury claim for auto accident back and neck injury not my fault. HELP?

My wife and I were in an auto accident in Feb 08. It was in our 1993 Chevy truck. The other driver ran a red light and hit the driver side. As a result my head broke out the driver side window. I did not go to the ER in the ambulance we drove after the report was filed with the police. I went for neck and low back pain and wife sustained buises to her right arm and right knee. They did a Catscan that ruled I had severe whiplash and for the back pain they told me to folow up with a chiro. I recieved 2 month of treatment from them for my back. I actually stopped going because the visits started hurting. After not going for a week or so. It still hurt a getting out of bed and every now and then it would remind me. I am a police officer and light duty is not an option. Anything can happen at anytime. About a month ago I woke on a day off and I couldn’t walk without have back pain and shooting pain around my ribs, breathing hurt.I thought it was the way I slept. cont.
The pain persisted all day. I decided to sleep on another bed. All night and the next morning PAIN,PAIN,PAIN. So I went to the ER I couldn’t even made it from the car to the door. After 7 hours of getting my pain under control.|The ER doctor advised that I have a herniated disc and gave me a week off work. So in bed on my back for four days pain lets up enough to return to work. I followed up with my doctor who gave me more pain medication and sent me for x-rays. Now at work I have to get out of my patrol car periodically because my legs go numb. |I have stopped wearing my bulletproof vest because it helps a little. BAD IDEA I know but what do I do Find a new career. Still have to go back to see what x-rays showed but I am wondering what to do about the injury settlement. We already settled the vehicle part. The damages were $7500 to the vehicle totalling it. Considering the truck was worth $5000.
All help from claim personal would be great!!!!!!!!!

What should i expect for my settlement check (auto accident)?

i was recently in a auto accident. my car insurance is allstate. i was not at fault and the other driver was cited at the accident for their driving. i was wondering how they calculate settlement checks? what can i expect back from them? i have heard that they take the amount of your treatment (ambulance, hospital, doctor, physical therapist, chiropractor ect.) and use that as a scale on which they calculate your payment. is that true?

my boyfriend was offered 500… he said that was unacceptable… they offered 700… he received 4000 with his last accident

also what is the best way to get a fair amount? if they are only willing to offer under 1000 should i get a lawyer?

it has been months since the accident… i have already been cleared from my doctor to work… so i have received my last lost wages check. i am finishing up my last chiropractor appointments… so i should be ready to begin my settlement process soon

I AM NOT TRYING TO GET PAYED OR COLLECT ON INSURANCE FRAUD.

i was in a legit accident… my first… i don’t want to be used by the insurance company… i want them to give me what i deserve due to my inconveniences not my greediness

all i am asking is how much others have gotten and how much i should expect also
please don’t assume the worst out of everyone. i am just a person who unfortunately was in an accident seeking information.

so basically the only interaction i have had with the insurance company is:
they payed for the value of my totaled car
they payed for a rental until i could find a new car
they payed my lost wages up until i was cleared to work with no restrictions from my doctor

so to my knowledge i should only be expecting a settlement check, for my pain and suffering and to cover any further medical bills after i settle.

so how much should i expect and if they don’t meet that is it worth getting a lawyer?

Auto accident fair settlement?

I was in an auto accident that was NOT my fault last August. An 18yr old kid talking on his cell phone pulled out in front of me. So far his insurance paid the $4000++ to have my car fixed. Two weeks of rental car. I have $1300 in Doctor bills that my policy as part of my policy is paying up until $2000. When we settle they get the $2000 first. I just finished physical therapy and they (the therapy place) are going to wait on the settlement to get paid. Having never been in an accident I do not know what to expect. I am going to have to settle soon as when that $2000 limit hits I will have to pay the doctor bills and I cannot afford it. It has made my pre-existing conditions worse forever. doc has stated this in letter.

Anyone have any idea how much I should expect from the company for ongoing treatment? My insurance company says it will not cover the rest of my life but an allowance will be made. He will not guess at an amount. Since I will have to settle early and not the 2 year

Pain & suffer claim for an auto accident@ my fault?

I just got a call from my auto insurance claim dept. rep. and told me that my family members can claim for Pain & Suffer due to my fault car accident that had been settled while back ( I was the driver and my family was passengers in my car).
It was a little shock that even if my faulty accident, but my family still can claim against my policy.
However, it is clear that my family can claim thru my policy and my insurance offer my wife for $5800, Kid#1 $5000, & Kid#2 $2104. Of course Nothing for me ^^;
Anyway, my wife med bill was $4800 and treatment takes near 2 months and still in minor pain, Kid#1 E.R. bill was $2600 & Treatment $1600 for 2 months, could not attend school for 2 weeks, and Kid#2 treatment $1600, no after pain.
I am sure that I will be facing a increasing ins in next renewal or maybe kick out.
Anyway, we decide to take a chance.
However, I calculated using a couple of website’s Pain & Suffer Claim calculator for offer, and find out my ins. offers are too low. Do I need to hire an attorney for the pain & suffer claim for my family to my faulty auto accident? The goal is very ovious that we try to get a better offer. Any advise will be appreciate.
