I was involved in an auto accident on 5/18/2008. I was driving northbound on interstate 95 headed to new york from virginia. When the accident occured I was In new jersey. Someone hit me in the passenger rear side which caused me to spin out of control and do about 3-4 360 degree turns down the freeway. I finally came to a STOP when the passenger side of my car hit the rear of an S.U.V. At that point the S.U.V stopped for a mere 1-2 seconds and sped off. I was left on the side of the highway by myself. Me and my passenger both sustained what we thought were minor injuries. An officer came wrote a police report (since there were no other vehicles that stopped he wrote it as hit/run). A tow truck then took my car off the turnpike and to the nearest local repair shop. I then had to take a TRAIN to new york from jersey to where my family lives. The next day I went to seek medical treatment for my neck/back/and right shoulder, so did my passenger. I got treatment 3 times a week from a chiropractor and got x-rays. The following week i returned home (virginia) where I found a chiropractor and had my medical files transferred. I have been seeing him since… I have seen a medical doctor, gone to get an MRI, and now have to go see an orthopedist. (The mri found i had a fracture in my shoulder) I went back to finally pick up my car from the shop the framework/ body work/ and paint had been done but they had not done anything mechanically to my car yet they insisted it was READY FOR PICKUP. i was furious so i end up driving my car back home to virginia because i could not waste any more time/money. My car still has check engine light on, abs light on, speedometer doesnt work, suspension was SHOT. the passenger side strut was blown i could tell cause that side of the car had no bouyancy (sp?) to it. I then called my lawyer and he called the insurance company and got them to replace that strut. EITHERWAY the car is still not mechanically sound and back to the state it was before the accident.
So I was in an auto accident back in November. I drove a focus, the other car was a mid 90′s suburban, and it side wiped me, and knocked my car over a lane. Luckily, no one was in the other lane, but it messed up my neck and lower back pretty bad.
I’ve been seeing a chiropractor since about a week after the accident, and he told me that it would be approx 6 months of treatment. It’s been about halfway through the time frame, and while I am better, my neck still hurts. I work an office job, so it’s got nothing to do with work.
I just found out today that the other person’s insurance is claiming that I have gone beyond a “reasonable” time for treatment, and that I am not supposed to go anymore, even though I’m still in pain. (I should note that I work for the insurance company that I am insured by, and so was the other party). My boss (an agent w/some claims background) has suggested that I may want to see an actual physician (as opposed to just the chiropractor) and get an “official” opinion. I’m thinking I may need to start looking at an attorney as well.
In order to avoid any additional expenses, I did stop going for now, as I can’t afford to risk any out of pocket expenses beyond what I’ve been treated for. But, I still hurt.
My question is should I wait and see if they cover all the expenses so far before getting an attorney or should I start looking into that option now? I don’t think its fair that I’m still in pain and am being told that my treatment is “unreasonable”.
I had an auto accident a year and a half ago. I have been undergoing treatment ever since. I am still going through treatment and may never stop going through treatment. The lawyer has received my dr’s narrative report and has sent a demand letter to the at fault insurance. My injuries are as follows:
1. Headaches
2. Cervicalgia-Neck Pain
3. Cervical sprain/strain
4. Cervical disc displancement
5. Lumbalgia-low back pain
6. Lumbar radiculitis
7. Lumbar disc displacement (L4-5,L5-S1)
8. Annular Tear (L4-5, L5-S1)
9. Unspecified disc disorder of lumbar region
10.Airbag burns to upper arm, LEFT
11.Hip Pain
12.Pelvic/thigh pain
13.Leg Pain
14.Multiple abrasions
15.Numbness/tingling
16.Muscle Spasms
17.Sleep Disturbance
My medical bills are in excess of $16,000 and increasing. I will be going to drs visits, getting injections, and taking medication for awhile, if not forever. Surgery is even a possibilty if I can get up the nerve to continue on with it. But from family experience, back surgery does not seem like a one time deal. They are always followed up with more surgeries, at least that is what I have observed.
I’m just looking for an estimate as to what I should expect. Or maybe what is a good offer. My life has drastically changed since the accident. I mean I am only 24 years old and I already have extreme pain everyday of my life. There is not one day that goes by that I am not reminded of that terrible accident. I am just happy to be alive. But I do think I should expect some kind of compensation due to the negligence of the other driver, whom was driving a company vehicle.
Thanks for any answers..just want opinions on what you all think would be considered a fair settlement.

I was in an auto accident where I was rear ended. The chiropractor was paid by the insurance company but when it was settled, I had to pay back the insurance for the chiroprator treatments. can I deduct this payment as a medical payment.
example:
Chriprator costs 3,000
settlement 10,000
reimburesment to insurance for chirpractor 3,000
net settlement 7,000
Thanks
I was injured in a car accident and subsequently lost my health insurance. I need treatment for the injuries I received. Does anyone know any doctors willing to take an auto accident case? I have had many doctors refuse to treat me under “third party liability”. I am in pain and really need the help. So if there’s any docs out there willing to bill the other parties auto insurance or send bills to my attorney…..pleaselet me know where. Preferably in the southern suburbs of Illinois. Joliet, Plainfield, Orland Patk….for examples.
I should probably mention…this car accident was in June of 2011 and I did go to the ER and get some treatments from my doc. The problem is that I lost my health insurance before I could get some relief of the pain. I have called several doctors offices and no one wants to take a third party liability case. That’s why I came here. Hoping someone, somewhere in Illinois knows a doc that can help.

Auto Accident settlement?

I am a 21 yr old male that was involved in an automobile accident in February of this year which resulted in my car being totalled. I feel they could have repaired the vehicle versus selling it at an auction. They wrote out a check for $13,500 to my finance company. I have been through a lot of pain and stress due to the fact that I lost my job because Georgia doesn’t offer public transportation to Suwanee and now I do not have a vehicle. I have to pay for bus transportation and rental cars to see the doctor for back and neck injuries and personal use. I was out of work for 6 months and the insurance company doesn’t want to pay me what I feel they should because they say I only suffer from soft tissue damage. I still have muscle spasms and headaches that I feel are accident related and ended treatment due to lack of transportation to Marietta and Roswell GA. Insurance company wants to settle for $1500 2nd offer. My medical bills, lost wages, pain and suffering are over $6000. I still have to pay doctor and attorney. Am scheduled to go to court but what do I do when Insurance company refuses to pay what I feel they should for a accident that wasn’t my fault. Doctor said I have nerve damage and torn ligaments. Why doesn’t insurance want to pay me?
To mushu
Yes it was my choice to hire an attorney. I don’t recall saying that his bill was the insurance company’s responsibility. I feel your comments should have been kept to yourself and for you to tell me it wasn’t the insurance company’s fault I owed that much on a vehicle you have lost your mind. I am fully aware that it wasn’t the insurance company’s responsibility for me to get to work. I was just mentioning all that I have had to deal with. It was an unfortunate event that the accident happened and if my attorney answered my questions I wouldn’t be here to begin with. What do you mean pain and suffering are not guaranteed? They’re customer caused me alot of pain and suffering in 6 months and as for loss wages? They don’t want to pay me that. I came here for information not to receive attitude from you!!!! Yes I have an itemized list from the my attorney that shows I should be getting paid more than $1,500 for injuries, loss wages, pain and suffering
I feel they don’t want to pay me just because they don’t want to. My doctor said it was more then just a soft tissue injury. This is a another scam. All of this is the customers fault because she was such in a hurry and I’m the one suffering because of her so the insurance company should pay thats why we have INSURANCE!!!!
